Analisis Penerapan Standar K3 dan Dampak dari Kelalaian Pelaporan Kecelakaan Kerja terhadap Perusahaan Berdasarkan Undang-Undang No. 13 Tahun 2003 Tentang Ketenagakerjaan

Abstract

Workplace accidents are a serious problem in the manufacturing industry, impacting workers' physical, psychological, and legal aspects. This study aims to analyze legal protection efforts for workers who are victims of work accidents based on Law Number 13 of 2003 concerning Manpower, which regulates workers' rights to Occupational Safety and Health. The method used is empirical juridical with a qualitative approach, with data collection techniques through interviews, observations, and documentation studies. In practice, PT.A in Karawang has implemented various forms of legal protection, like the provision of personal protection equipment, occupational safety training, compensation, and participation in the employment social security program. The investigation's conclusions show that the level of implementation is still not optimal, approximately 60% of the implementation of safety procedures is effective, while the rest still face obstacles such as low worker compliance, administrative obstacles, and lack of supervision. In addition, approximately 40% of workers do not fully understand their legal rights related to work accidents. These findings indicate a discrepancy between industry practices and rules. Therefore, efforts are needed to increase supervision, worker education, and improve the administrative system to ensure that legal protection can run effectively and sustainably. Additionally, make sure the implementation of the rights of workers is running as well as in compliance with Law Number 13 of 2003 concerning Manpower, which governs Workers' Rights to Obtain K3 Protection.
