Kewenangan Otorita IKN dalam Perspektif Pasal 18 UUD 1945: Negara dalam Negara

This study examines the anomaly of the Nusantara Capital City Authority from the perspective of Articles 18, 18A, and 18B of the 1945 Constitution using the concept of a state within a state as the main analytical approach. The study is motivated by the inconsistency between Law No. 3 of 2022 concerning the National Capital City, as amended by Law No. 21 of 2023, and the regional government framework mandated by Article 18 of the 1945 Constitution, particularly regarding the existence of regional parliaments and democratic regional elections. This study employs normative legal research or doctrinal research using a statute approach and a conceptual approach. Primary legal materials include the 1945 Constitution, the IKN Law, the Regional Government Law, and Presidential Regulations concerning the IKN Authority, while secondary materials consist of Sinta 1 and Sinta 2 journals published from 2022 to 2025, Constitutional Law books, and Constitutional Court decisions. The findings identify four main issues: the unclear position and regulatory hierarchy of the IKN Authority, democratic concerns arising from the absence of a regional parliament and regional head elections, a forced interpretation of Article 18B paragraph (1), and symptoms of a state within a state reflected in super authority, weak checks and balances, overlapping powers, and a hybrid governance model. The study concludes that the IKN Authority should be reformulated into an autonomous and democratic province.
