Ketidakstabilan Regulasi Social Commerce dan Implikasinya terhadap Kepastian Hukum Konsumen di Indonesia

Abstract

The growth of social commerce in Indonesia has outpaced the adaptive capacity of its electronic trade (PMSE) regulatory framework. The implementing regulation that currently governs PMSE business licensing was drafted before social commerce, a business model merging social-networking functions with transactional features, grew significantly in Indonesia, and therefore contains no explicit definition or categorization of that model. This article analyzes that normative vacuum (leemte in het recht) and its implications for consumer legal certainty through Gustav Radbruch's legal certainty theory and Nonet and Selznick's responsive law theory. The study uses a normative-juridical method with statutory, conceptual, analytical, and comparative approaches, relying on primary, secondary, and tertiary legal materials analyzed through grammatical, systematic, and teleological interpretation, as well as legal construction through analogy and argumentum a contrario. The analysis finds that, grammatically, the existing norm is broad enough to bring social commerce operators within the general definition of PMSE operators, yet systematically and teleologically the norm was never designed to accommodate social commerce's distinctive characteristics, producing an interpretive dissonance that results in unclear legal status, ambiguous liability, and fragmented dispute resolution. Comparison with the European Union, Singapore, and China shows that more responsive frameworks are built through explicit business-model categorization from the outset, rather than extensive interpretation of general norms. The article recommends supplementary technical provisions explicitly categorizing social commerce, periodic regulatory review obligations, and institutionalized online dispute resolution.
