Abstract

This study examines the political rights of former corruption convicts from the perspective of human rights and the Indonesian legal system, as well as their implications for democratic backsliding. Employing a normative juridical method with secondary data drawn from legislation, Constitutional Court decisions, and legal literature. The findings indicate that although the political rights of former corruption convicts are constitutionally guaranteed, the restrictions imposed through a five-year waiting period and legal status transparency requirements under PKPU Number 10 of 2023 remain procedural and insufficient in practice. The candidacy of former corruption convicts contributes to democratic decline through normative, institutional, electoral, and cultural pathways, further exacerbated by populist strategies and political party pragmatism. Restricting the political rights of former corruption convicts should therefore be viewed as a substantive protective measure to safeguard the integrity of local democracy in Indonesia.
