Abstract

The 1945 Constitution of the Republic of Indonesia explicitly guarantees the right to a clean and healthy environment as part of human rights. However, in practice, there is a wide gap between this constitutional mandate and the reality of increasing environmental degradation in Indonesia. This study aims to analyze the causes of the state’s failure to fulfill this constitutional right from a constitutional law perspective. The research method employed is a normative legal analysis using a statutory approach and a conceptual approach. The main findings of this study indicate that the state’s failure stems from complex constitutional implications, including: (1) The occurrence of administrative malpractice in the permitting process, which tends to be exploitative; (2) Regulatory disharmony, particularly following the enactment of the Job Creation Law, which has reduced environmental control mechanisms; and (3) Weak state responsibility in enforcing the law against environmental violations. These implications lead to the disregard of citizens’ human rights and the erosion of the Green Constitution principle. This study recommends the need to strengthen the control functions of state institutions and revitalize the role of the courts in realizing ecological justice through the constitutional complaint mechanism.
